What does that mean in practice?
The buyer applies in their own name, the seller keeps operating until the handover is lawful, and the agreement defines what happens if approval takes longer than expected.
Can the buyer operate under the seller's licence in the meantime?
Not as owner. Where an interim arrangement is needed, it has to be structured carefully and checked against current state requirements and legal advice before anyone relies on it.
How does this affect the price?
It rarely changes value, but it changes timing and risk allocation — deposits, contingency periods and who carries operating risk during the approval window.
What should sellers do about it?
Qualify buyers on licensability before accepting an offer. A buyer who cannot realistically be licensed costs the seller months and, often, census.
